사회 “무엇이 검정고무신 작가를 죽게 만들었나?”
글쓴이 성일 / 2023년 3월 11일, 《검정고무신》의 그림작가인 이우영 작가가 자택에서 극단적 선택을 했다. 원인은 만화 《검정고무신》의 사업화를 맡은 형설앤의 장대표가 원작자인 故이우영 작가를 저작권법 위반으로 고소하면서, 4년이 넘는 소송 기간 동안 정신적 고통에 시달렸기 때문으로 여겨진다. 어떻게 원작자가 사업자에게 고소를 당할 수 있을까. 해당 사건의 내막을 자세히 들여다보았다. 문제는 《검정고무신》의 그림작가인 이우영, 이우진 작가 그리고 글작가인 이영일 작가가 형설앤 측과 총 3차례에 걸쳐 맺은 사업권 설정 계약으로부터 시작된다. 1차와 2차 사업권 설정 계약 당시에는 5년 단위로 계약 기간이 정해졌지만 3차부터는 계약 종료 기간이 정해지지 않은 채 계약이 체결되었다. 이우영 작가 사건 대책위원회(이하 대책위)의 대변인 김성주 변호사는 이를 두고 “사업체 측에서 무기한으로 《검정고무신》에 대한 저작재산권 이른바 사업권으로 표현된 권한을 가져간 것”이라고 표현했다. 이에 《검정고무신》 원작자 이우영, 이우진, 이영일 작가는 형설앤 측에 지속적으로 계약을 공정한 방향으로 수정해줄 것을 요청해왔다. 그러나 2019년 5월, 형설앤의 장대표는 대화에
